These terms and conditions of sale are entered into, on the one hand, by Sprl “L’Art de Praslin”, whose registered office is situated at 12 Rue de Nivelles, B-1300 Wavre, registered with the Crossroads Bank for Enterprises under n° BCE 0433.879.218 and, on the other, any natural person or legal entity wishing to make a purchase from the Art de Praslin website (en.artdepraslin.be), hereinafter “the purchaser”.
A) Purpose
These terms and conditions of sale are designed to define the contractual relationship between Art de Praslin and the purchaser, as well as the conditions that apply to any purchase made through the Art de Praslin trading website, whether the purchaser is a commercial business or private consumer.
Acquiring goods through this website implies the unconditional acceptance by the purchaser of these terms and conditions of sale.
These terms and conditions of sale take precedence over any other general or special terms and conditions not expressly agreed to by Art de Praslin. Art de Praslin reserves the right to modify its general terms and conditions at any time. If this should be the case, the terms and conditions that apply will be those in effect at the time the order is placed by the purchaser.
B) Features of the goods offered
The products offered are those featured in the catalogue published at the Art de Praslin website.
These products are offered while the available stocks last.
Each product is accompanied by a description drawn up by the supplier.
The photographs used in the catalogue are as faithful as possible, although they cannot provide a perfect depiction of the product offered.
C) Prices
The prices stated in the catalogue are in euro and include the rate of VAT in effect at the time of the order; any change in the rate of VAT may be reflected in the price of the products or services.
Art de Praslin reserves the right to modify its prices at any time, although it is understood that the price stated in the catalogue at the time of the order will be the price that applies to the purchaser.
The prices shown do not include the charges for carriage and delivery.
D) Orders
Purchasers wishing to buy a product are required to:
- complete the identification sheet on which they must state all of details requested, or give a customer number, if they have one;
- complete the online order form, stating all of the product references selected;
- approve their order, after checking it;
- make payment on the terms stated;
- confirm their order and payment.
Confirmation of the order implies acceptance of these terms and conditions of sale, acknowledgment that the purchaser has read said T&Cs and waives his/her/its own terms and conditions of purchase or any other conditions.
The body of details provided and registration of the order confirmation will provide valid proof of the transaction. Confirmation of the order will serve as signature and acceptance of the transactions conducted.
The seller will send confirmation of the order registered by electronic mail.
E) Cancellation
Goods specially designed for the purchaser and/or which may deteriorate quickly (pralines) will not be taken back, not may the purchaser invoke the cancellation clause.
F) Payment terms
The price is due for payment at the time of the order.
Payments will be taken using the secure Ogone system. This gives you access to secure payment and the option to pay using any of the major credit cards.
Ogone is a committed international operator, providing you with customer support in French, English, Dutch and German.
The purchaser’s account will not be debited until the products are shipped.
At the purchaser’s request, a paper invoice will be sent showing the VAT component.
G) Deliveries
Deliveries will be made to the address stated on the purchase order. Delivery may only be made to the geographical area agreed.
Any risks are incumbent on the purchaser from the time the products leave the premises of Art de Praslin. In the event of damage during transport, a complaint, stating reasons, must be lodged with the carrier within three days from the time of delivery.
The delivery times given are indicative only; if delivery exceeds thirty days from the time the order is placed, the contract of sale may be cancelled and the purchased reimbursed.
H) Liability
As part of the process of online sales, the seller is bound only by an obligation as to means; it may not be held liable for any damage resulting from use of the Internet, such as loss of data, intrusion, virus, interruption of service, or other unintentional problems.
I) Intellectual property
All of the elements featured at the Art de Praslin website are and will remain the intellectual and exclusive property of Art de Praslin.
No one is authorised to reproduce, exploit, must-carry or use in any form whatsoever, even partially, any elements of the website, whether they be software-related, sound or vision.
Any simple link or by hypertext is strictly forbidden without the express written consent of Art de Praslin.
J) Settlement of disputes
These online terms and conditions of sale are governed by Belgian law. In the event of a dispute, jurisdiction is granted to the competent courts in Nivelles.
